1. About Park96815

Park96815 is operated by Stefan Motz as a sole proprietorship in Hawaii. Park96815 provides an online marketplace through park96815.com and the Park96815 mobile app that allows parking-space owners to offer parking spaces and renters to reserve those spaces.

Park96815 is a marketplace platform. Unless expressly stated otherwise, Park96815 does not own, operate, control, or manage the parking spaces listed by owners.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Park96815.

Parking-space owners must have the legal right and authority to offer the parking space they list.

3. Parking Reservations

A reservation is confirmed after successful payment and confirmation through Park96815. Renters may use the parking space only for the dates, times, vehicle, and conditions included in the reservation.

Renters must follow all posted rules, building requirements, access instructions, and reasonable owner instructions relating to the parking space.

4. Payments and Fees

Payments are processed through Stripe. Park96815 may collect the full reservation amount from the renter and retain a platform commission before the owner's share is paid or recorded for payout.

Park96815 currently uses an 85% owner / 15% Park96815 revenue split unless a different arrangement is expressly stated.

Owner payouts are handled through Stripe Connect for eligible connected owners. Park96815 may deduct its platform commission before the owner's share is transferred through Stripe. Payout timing and availability may depend on Stripe's processing, account status, and applicable banking rules.

5. Renter Cancellations and Refunds

A renter is eligible for a full refund when the cancellation is requested at least 24 hours before the reservation start time.

Cancellations requested within 24 hours of the reservation start time, or after the parking period has begun, are generally non-refundable.

If Park96815 or the parking-space owner cancels a confirmed reservation, the renter will receive a full refund.

6. Owner Responsibilities

Owners are responsible for ensuring that they have the legal right to offer the space, that listing information is accurate, and that the parking space is reasonably safe, accessible, and available during confirmed reservation periods.

Owners must disclose material restrictions, access limitations, vehicle-size limits, building rules, and other conditions that could affect a renter's use of the space.

Once a reservation has been paid, an owner should cancel only when the space genuinely becomes unavailable or because of an emergency. When an owner cancels, the renter receives a full refund and the owner receives no earnings from that reservation.

7. Renter Responsibilities

Renters are responsible for using a legally operable and properly insured vehicle and for complying with applicable laws, property rules, access instructions, and parking restrictions.

Renters may park only during the reserved period and in the assigned or authorized space.

Parking spaces may not be used for unlawful activity, hazardous materials, unauthorized commercial activity, vehicle repairs, or long-term vehicle storage unless specifically authorized.

8. Vehicle and Property Risk

Parking inherently involves risks including theft, vandalism, weather, collision, towing, property damage, and other loss. Renters remain responsible for their vehicles and personal property.

Park96815 does not guarantee the security, condition, availability, legality, or suitability of any parking space listed by an owner.

9. Marketplace Role and Limitation of Liability

Park96815 facilitates transactions between renters and parking-space owners but is not the owner, landlord, operator, or insurer of listed parking spaces.

To the fullest extent permitted by applicable law, Park96815 is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the platform or a parking space.

Nothing in these Terms excludes or limits any right or liability that cannot lawfully be excluded or limited.

10. Prohibited Conduct

Users may not provide false information, misuse payment systems, interfere with the website, attempt unauthorized access, use a parking space for unlawful purposes, or engage in fraudulent, abusive, or deceptive conduct.

11. Suspension or Termination

Park96815 may suspend or terminate access, remove listings, or cancel transactions when reasonably necessary to address fraud, safety concerns, legal requirements, misuse of the platform, or violations of these Terms.

12. Changes to These Terms

Park96815 may update these Terms from time to time. The effective date shown at the top of this page will be updated when material revisions are made.

13. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles, except where applicable law requires otherwise.
